This Privacy Policy does not replace any Notice of Privacy Practices required under the Health Insurance Portability and Accountability Act (“HIPAA”) or other applicable healthcare privacy law. If information is protected by HIPAA or another law that provides different or additional protections, Regency will handle that information in accordance with the applicable law and any applicable Notice of Privacy Practices.

Third-party websites, applications, and services linked from the Website are governed by their own privacy practices.

Advertising and Analytics Partners

Subject to applicable law and your consent or opt-out preferences, certain Website activity information may be disclosed to analytics, measurement, or advertising partners.

Some privacy laws may define certain advertising-related disclosures as a “sale,” “sharing,” or processing for “targeted advertising,” even where Regency does not receive money in exchange for the information.

Where applicable, you may opt out as described under Your Privacy Choices below.

Legal, Safety, and Compliance Disclosures

We may disclose information when reasonably necessary to:

  • Comply with a law, regulation, court order, subpoena, or legal process;

  • Sale of assets;
  • Change of control; or
  • Similar corporate transaction.

At Your Direction

We may also disclose information when you request, direct, authorize, or consent to the disclosure.

8. Sensitive and Health-Related Information

Because Regency provides senior living services, a Website inquiry may sometimes relate to an individual’s health, care needs, or other sensitive circumstances.

Regency takes additional precautions concerning this type of information.

We do not intend for advertising or non-essential tracking technologies to collect information entered into forms or pages designated for medical, health, resident intake, payment, account-login, or similarly sensitive purposes.

Regency does not use Personal Information concerning an individual’s medical condition or care needs for targeted advertising.

Do not send detailed medical records or other protected health information through an ordinary Website contact form or ordinary email unless Regency specifically instructs you to use that method.

Where information is subject to HIPAA, it will be handled under applicable HIPAA requirements and any applicable Regency Notice of Privacy Practices rather than solely under this Website Privacy Policy.

9. Sale, Sharing, and Targeted Advertising

Regency does not sell Personal Information in exchange for money.

However, depending upon the technologies used on the Website, certain disclosures to advertising or analytics providers may be considered a “sale,” “sharing,” or use for “targeted advertising” under some U.S. state privacy laws.

Where applicable, you may opt out of these activities by:

  • Selecting Reject or the applicable choice in our cookie consent tool;
  • Selecting Cookie Preferences or Manage Preferences;
  • Using our Do Not Sell or Share My Personal Information or equivalent privacy-choice link;
  • Submitting a privacy request using the contact information below; or
  • Using a legally recognized browser-based opt-out preference signal, such as Global Privacy Control (“GPC”), where required.

Regency will process legally recognized opt-out preference signals in accordance with applicable law.

10. Your Privacy Rights

Depending upon where you live and the law applicable to Regency, you may have rights concerning your Personal Information, including the right to:

  • Exercise privacy rights without unlawful discrimination or retaliation.

These rights are not absolute. Applicable law may permit or require us to retain or use information for purposes such as completing a transaction, maintaining security, complying with legal obligations, protecting rights, or other lawful purposes.

11. California Privacy Rights

If Regency is subject to the California Consumer Privacy Act, as amended (“CCPA”), California residents may have the rights provided under that law, including rights to:

  • Know the categories and specific pieces of Personal Information collected;
  • Access Personal Information;
  • Correct inaccurate Personal Information;

The business or commercial purposes and categories of recipients are described elsewhere in this Privacy Policy.

Regency’s practices concerning “sale” and “sharing” for purposes of advertising are described in Section 9.

Regency does not knowingly sell or share Personal Information of consumers under 16 years of age.

12. Exercising a Privacy Request

To submit an access, correction, deletion, opt-out, or other privacy request, contact us through one of the following methods:

Privacy Phone: (706) 235-0807

Regency may need to verify your identity before processing certain requests. Verification information will be used only as reasonably necessary to verify and process the request.

Where permitted by law, an authorized agent may submit a request on your behalf. We may request evidence of the agent’s authority and may need to verify your identity directly.

If applicable state law provides a right to appeal a denial of a privacy request, instructions for submitting an appeal will be provided with our response.

13. Global Privacy Control

Where legally required, Regency recognizes qualifying browser-based opt-out preference signals, including Global Privacy Control (“GPC”), as a request to opt out of the sale or sharing of Personal Information or targeted advertising for the browser or device transmitting the signal.

Because GPC is generally device- and browser-specific, you may need to enable it separately on each browser or device you use.

14. Marketing Communications

You may unsubscribe from marketing emails by selecting the unsubscribe link included in those communications.

You may opt out of marketing text messages using the opt-out instructions provided in the message, such as replying STOP, where applicable.

Marketing consent is not a condition of purchasing or receiving Regency’s senior living services except where otherwise permitted by law.

Even after opting out of marketing communications, Regency may continue to send transactional, service-related, safety, legal, or other non-marketing communications where appropriate.

15. Telephone and Text Communications

If you provide a telephone number and affirmatively agree to receive telephone or text communications, Regency or its authorized service providers may contact you in accordance with the consent provided and applicable law.

Where legally required, consent to automated or marketing calls or texts will be obtained separately through clear disclosure at the point of collection.

You may revoke applicable consent through any reasonable method recognized by law, including using the opt-out instructions included in communications.

16. Data Retention

Regency retains Personal Information for no longer than reasonably necessary for the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law.

Retention periods may depend upon:

  • The nature and sensitivity of the information;
  • The purpose for which it was collected;
  • The duration of an inquiry or relationship;
  • Legal and regulatory requirements;
  • Recordkeeping obligations;
  • Fraud-prevention or security needs;
  • Applicable limitation periods; and
  • The need to establish, exercise, or defend legal claims.

Regency maintains internal retention practices for Website inquiries, marketing records, communications, analytics, system logs, backups, and other categories of information.

17. Data Security

Regency uses reasonable administrative, technical, and physical safeguards designed to protect Personal Information against unauthorized access, acquisition, disclosure, alteration, loss, or destruction.

Depending upon the nature of the information and systems involved, safeguards may include:

  • Encryption in transit;
  • HTTPS;
  • Access controls;
  • Multi-factor authentication;
  • Role-based permissions;
  • Security monitoring;
  • Malware protection;
  • Website firewalls;
  • Logging;
  • Backups;
  • Vendor-management procedures;
  • Vulnerability and patch management; and
  • Other appropriate security controls.

No method of Internet transmission or electronic storage can be guaranteed to be completely secure. Accordingly, Regency cannot guarantee absolute security.

If you believe information you provided to Regency has been compromised, contact us promptly using the privacy contact information below.

18. Third-Party Websites and Embedded Services

The Website may link to or incorporate third-party services such as:

  • Maps;
  • Video players;
  • Social media features;
  • Review platforms;
  • Payment services;
  • Chat services;
  • CAPTCHA services; or
  • Other third-party websites or applications.

These third parties may process information under their own terms and privacy policies.

Where an embedded third-party service involves non-essential tracking, Regency will use consent controls where required by applicable law.

Regency is not responsible for the independent privacy practices of third-party websites or services that it does not control.

19. Children

The Website is intended for adults seeking information about Regency services and is not directed to children under 13.

Regency does not knowingly collect Personal Information online from children under 13 through the Website without legally required parental consent.

If you believe a child has provided Personal Information to Regency through the Website inappropriately, please contact us.

20. Do Not Track

Some browsers provide a “Do Not Track” setting. Because there is not a universally accepted standard governing all Do Not Track signals, the Website may not respond to traditional Do Not Track signals.

This does not affect Regency’s obligation to recognize legally required opt-out preference signals such as Global Privacy Control where applicable.

21. Changes to This Privacy Policy

We may update this Privacy Policy periodically to reflect changes in:

  • Our Website;
  • Our information practices;
  • Our technology;
  • Applicable law; or
  • Our business operations.

When we update the Privacy Policy, we will revise the “Last Updated” date above.

Where required by law, we will provide additional notice or obtain consent before a materially different use of previously collected Personal Information.
